Tax FAQs

Do I need to file taxes if I'm undocumented?
Yes. All individuals who earn income in the United States are required to file taxes, regardless of immigration status. If you don't have a Social Security Number, you can use an ITIN (Individual Taxpayer Identification Number). Filing taxes can also help establish a record of good standing, which may be beneficial for future immigration applications.
What is the difference between an ITIN and a Social Security Number?
A Social Security Number (SSN) is issued by the Social Security Administration to U.S. citizens and authorized non-citizens. An ITIN is issued by the IRS specifically for tax purposes to individuals who are not eligible for an SSN. An ITIN cannot be used for work authorization or to receive Social Security benefits — it is for tax filing purposes only.
Can I claim the Earned Income Tax Credit (EITC) with an ITIN?
No. The EITC requires a valid Social Security Number for you, your spouse (if filing jointly), and any qualifying children. However, there are other credits available to ITIN holders, such as the Child Tax Credit (for qualifying children with SSNs) and the Additional Child Tax Credit. We can help you identify all credits you're eligible for.
What happens if I haven't filed taxes for several years?
It's important to get caught up as soon as possible. The IRS has programs to help taxpayers who are behind on filing. We can prepare prior year returns and help you understand your options, including payment plans if you owe taxes. In some cases, you may actually be owed refunds for prior years. Don't wait — penalties and interest continue to accrue.
